A request was received in the Engineering Office on 5/18/15 requesting the requirement to install sidewalk along Highway 16 per City of Rapid City Ordinance 12.08.060 be waived. A 5’ sidewalk is required to be constructed along Highway 16 at the time of building permit, with the property having approximately 265 feet of frontage along Highway 16. The requested variance will allow for construction of professional offices on the property without the installation of sidewalk in the adjacent right-of-way. This property is a planned development (14PD043). Adjacent Highway 16 is a principal four-lane divided arterial street with no sidewalk and a rural street section with ditches to accommodate drainage. There are currently no pedestrian access routes in the Highway 16 right-of-way.
There is one option for sidewalk; install the sidewalk 1 foot inside the right-of-way. At this time there are no sidewalks on Highway 16 south of the current Mount Rushmore Road reconstruction project that begins at Tower Road.
Based upon Highway 16 being a principal four-lane divided arterial street with a posted speed limit of 60 miles per hour and the lack of pedestrian traffic in the area, it seems reasonable to allow a variance to the sidewalk requirement until development in the area necessitates construction of pedestrian access along Highway 16. The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary. |
